1. Acceptance of Terms
By accessing or using CallVisor's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Description of Service
CallVisor provides a cold-call coaching dialer for real estate acquisitions teams that includes:
- Outbound calling capabilities through integrated telephony services
- Real-time call transcription
- AI-powered coaching and suggestions
- Call recording and analytics
- Contact and campaign management
3. Account Responsibilities
You are responsible for:
- Maintaining the security of your account credentials
- All activities that occur under your account
- Ensuring your team members comply with these terms
- Providing accurate account information
4. Acceptable Use
You agree NOT to:
- Use the service for illegal purposes or in violation of any laws
- Make calls that violate telemarketing regulations (TCPA, GDPR, etc.)
- Harass, threaten, or abuse call recipients
- Attempt to reverse engineer or compromise the platform
- Share your account with unauthorized users
- Use the service to compete directly with CallVisor
5. Calling Compliance
You are solely responsible for complying with all applicable telemarketing and communication laws, including but not limited to:
- Telephone Consumer Protection Act (TCPA)
- Do Not Call Registry requirements
- GDPR and international privacy regulations
- State-specific telemarketing laws
6. Subscriptions and Billing
6.1 Subscription Plans
The price for use of the Platform is set forth in your subscription agreement with us. Fees are charged for subscriptions at our sole discretion and may be updated or changed from time to time. Any price changes will be communicated to you through email or our website and will take effect at the start of the next billing period. Continued use of services after the price change constitutes acceptance of the new price.
6.2 Free Trial
New users receive a free trial with access to Pro features. No payment information is required to start the trial. At the end of the trial period, you must select a paid plan to continue using the service. Unused trial time is forfeited upon upgrading to a paid plan.
6.3 Payment Terms
- Subscription fees are billed in advance on a monthly or annual basis
- Usage-based charges (call minutes, SMS overages) are billed at the end of each billing period
- All fees are in US dollars unless otherwise specified
- We reserve the right to change pricing with 30 days notice to existing subscribers
6.4 Cancellation Policy
You may cancel your subscription at any time through your account settings or by contacting support. Upon cancellation:
- Your subscription will remain active until the end of the current billing period
- You will continue to have full access to all features until the period ends
- No prorated refunds are provided for unused time in the current period
- Your data will be retained for 30 days after your subscription ends
6.5 Refund Policy
All subscription fees are non-refundable. This includes:
- Monthly and annual subscription fees
- One-time setup fees (if applicable)
- A2P 10DLC registration fees
- Phone number purchases and renewals
Exceptions may be made at CallVisor's sole discretion in cases of:
- Service unavailability exceeding uptime guarantee
- Billing errors caused by CallVisor
- Documented technical issues preventing service use
6.6 Plan Changes
You may upgrade or downgrade your plan at any time. Upgrades take effect immediately with prorated charges. Downgrades take effect at the start of your next billing period.
7. Intellectual Property
CallVisor retains all rights to the platform, including software, AI models, and documentation. You retain ownership of your call recordings, transcripts, and contact data.
8. Limitation of Liability
To the maximum extent permitted by law, CallVisor shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
9. Termination
9.1 Voluntary Termination
You may cancel your subscription at any time. Your access will continue until the end of your current billing period, after which your account will be downgraded.
9.2 Termination by CallVisor
We may suspend or terminate your account immediately for:
- Violations of these Terms of Service
- Non-payment of fees after reasonable notice
- Fraudulent or abusive use of the service
- Legal requirements or court orders
9.3 Effect of Termination
Upon termination:
- All rights granted to you under these terms cease immediately
- You may request export of your data within 30 days
- Your data will be deleted after 30 days unless legally required to retain
- Any outstanding fees become immediately due and payable
10. Changes to Terms
We may update these terms from time to time. We will notify you of material changes via email or through the platform. Continued use after changes constitutes acceptance.
